This paper focuses on"Teşkilat-ı Esasiye Kanunu", the fırst Constitution that legalized the regime of the first Assembly opened on 23 April 1920 in Ankara. This Act was the lirst constitution of the new Turkish Republic vvhich was adopted on 20 January. 1921 with no. 85. By means of this constitution. the assembly goverment legalized itself depending on the principle that law is superior than any other organ, it is understood in the records of the Assembly that three significant points have been found out discussing this law: the fırst is a clear protest against the Sultan and Caliph. The second is uniting the authority in the personality of Mustafa Kemal Pasha as the head of Minister's Council, not as the head of assembly in the goverment system. The third is the clear opposition of some representatives against Mustafa Kemal Pasha on these meetings.
